Artist - Terms & Conditions
1. Introduction
These Terms & Conditions (“Agreement”) outline the rights and responsibilities of artists (“Artist”) who list and sell their artwork through Coastal Art Australia (“Gallery,” “We,” “Us,” “Our”). By joining Coastal Art Australia, you agree to these terms.
2. Eligibility
To list your artwork on Coastal Art Australia, you must:

Be the original creator of the artworks you list.

Be an Australian resident or currently living in Australia.

Ensure all artworks align with the coastal/beach theme.

Provide high-quality images and accurate descriptions of your work.
3. Listing and Sales

There is no upfront cost to list your artworks on Coastal Art Australia.

The Gallery will take a 20% commission on each sale.

The Artist retains full ownership of their artworks until sold & delivered to customer.

Artworks listed on Coastal Art Australia are non-exclusive, meaning you can sell them on other platforms or through other means.

The Artist is responsible for ensuring the listed artworks are available and notify Coastal Art Australia if an artwork sells elsewhere.

If the Gallery runs a sale or promotion, any discount will be applied to the original price, and the adjusted amount will then be split according to the standard 80/20 commission structure. Discounts will not be applied without prior discussion with the Artist.
4. Pricing & Payment

The Artist sets their own retail prices, but prices must be consistent across all platforms.

Payments to the Artist will be made via bank transfer within 7 days of delivery of artwork.

The 20% commission will be deducted before payment.
5. Shipping & Delivery

The Artist is responsible for packing and shipping artworks directly to the customer.

Shipping costs must be factored into the artwork price.

The Artist must provide tracking details to Coastal Art Australia and the customer once shipped.

If an artwork is damaged or lost in transit, the resolution is between the Artist and the courier/shipping provider.
6. Commissioned Artwork

If a customer commissions an artwork through Coastal Art Australia, the Gallery will take a 50% deposit upfront and the remaining 50% before delivery.

Payments to the Artist will be made via bank transfer within 7 days of delivery of artwork.

The commission process, including deadlines and customer requirements, must be agreed upon by both the Artist and the Gallery before the project begins.
7. Private Sales

If an Artist sells an artwork privately to a customer who discovered them through Coastal Art Australia (e.g., the customer saw the work on the website or was referred by the Gallery), the Artist agrees to notify the Gallery and pay 20% commission of the sale price.
8. Marketing & Promotion

Coastal Art Australia will promote the Artist’s work via the website, social media, and other marketing channels.

The Artist agrees to allow Coastal Art Australia to use images of their artwork for promotional purposes.

The Artist retains copyright of their artworks at all times.
9. Returns & Refunds

Coastal Art Australia does not offer returns or refunds unless the artwork arrives damaged.

If a dispute arises, the Artist, buyer and Coastal Art Australia will work together to find a resolution.
10. Removal of Artworks or Artist

The Artist may remove their artworks from the Gallery at any time by providing written notice.

Coastal Art Australia reserves the right to remove any Artist or artwork that does not align with the gallery’s theme, is misrepresented, or violates this Agreement.
11. Amendments
Coastal Art Australia reserves the right to amend these terms at any time. Artists will be notified of any significant changes.
